This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you (the "Licensee" or "you") and Encounter GG (the "Licensor," "we," "us," or "our") for the software product "Encounter: The Lost Cards," including any demos, updates, and all versions thereof (collectively, the "Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
Subject to your compliance with the terms of this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Software on a single computer or device that you own or control (or as expressly permitted by Steam's Family Sharing features), solely for your personal, non-commercial entertainment purposes.
You agree not to, and not to permit any third party to, do any of the following: a. Exploit the Software or any of its parts for any commercial purpose, except for the creation and monetization of video content (e.g., "Let's Plays", live streams, reviews) on platforms such as YouTube and Twitch, provided such content adds your own creative input. b. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code for the Software. c. Copy, modify, adapt, or create derivative works based on the Software. d. Sell, rent, lease, sublicense, distribute, or otherwise transfer your rights to the Software. e. Remove, alter, or obscure any proprietary notices or labels on or in the Software. f. Use cheats, exploits, automation software (bots), hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Software experience, particularly any action intended to manipulate or disrupt the in-game economy, offline save states, or its interaction with the Steam platform.
All rights, title, and interest in and to the Software and any and all copies thereof are owned by Encounter GG. The Software is protected by the copyright laws of Canada, international copyright treaties, conventions, and other laws. All rights not expressly granted to you herein are reserved by the Licensor.
Your use of the Software is also governed by our Privacy Policy, which outlines our practices regarding the collection and use of data. Please review the Privacy Policy for detailed information.
The Software may contain or utilize third-party software or services, such as Cloudflare. Your use of the Software is also subject to the terms and conditions of these third parties.
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from the Licensor if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE.
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
The original version of this Agreement is in English. Any translations are provided for convenience only. In the event of any conflict or inconsistency between the English version and a translation, the English version shall govern and control.
We reserve the right to modify this Agreement at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document and, where practicable, via in-game notifications or through the Steam platform. Your continued use of the Software after the effective date of any changes constitutes your acceptance of the revised Agreement.
